The Terms & Conditions for user / member of docOPD Health Card (hereinafter referred to as 'DHC') property of “docOPD Technologies Pvt Ltd”, a company duly registered under the Companies Act, 1956 (or 2013 as the case may be). “docOPD Technologies Pvt Ltd” (hereinafter referred to as 'DTPL’) provides its’ services to its’ subscribers through its’ Website, Mobile App available as a free download at App Store & the offers made on the docOPD Health Card may periodically change and having three variants with different costing. We hence request you to check for these changes on the website & by calling us on our help line numbers on a regular basis. Any user who buys DHC subscription, become DHC paid member or member for one-year period from the date of mobile app activation of DHC, therefore docOPD Health Card Member (hereinafter referred to as 'Member' also called “user” or “subscriber”) is defined as an individual who has a valid and paid docOPD Health Card issued by docOPD Health Card, any visitor or registered non-paid member are called only “subscriber” or “user”.
The user who accesses the instant site/domain for use of the subscription services, agrees to be over 18 years of age and competent to enter into a legally binding contract as per the Indian Contract Act, 1872 for enabling him/her to register, use these Subscription Services in any manner. By registering, or accepting this Agreement, the user represents and warrants that he/she has the right, authority and capacity to use the Subscription Services available through the www.docOPD.com and agree to and abide by this Agreement. The user further represents and warrants that he/she is not barred from receiving the Subscription Services under any of the laws of India or other countries including the country, for the time being in force, in which the user is a resident or from which the user proposes/intends to use the Subscription Services.
“DTPL”. authorizes the User to view and access the content available on the Subscription Services solely for ordering, receiving, delivering and communicating only as per this Agreement. The contents of the Subscription Services, information, text, graphics, images, logos, icons, tabs, software code, design, and the collection, arrangement and assembly of content on the Subscription Services (collectively referred to as, "xyz content"), are the exclusive property of “DTPL”. and are protected under relevant Copyright, Trademark and other laws for protection of the Intellectual Property Rights. User shall not alter, modify or resort to unauthorized reproduction or copying of the “DTPL” Content and/or use, display, publicly perform, distribute, or otherwise use the same in any way for any public or commercial purpose or for personal gain.
The User expressly agrees not to make any wrongful disclosure/information on the site www.docOPD.com and further understands that the user shall be solely responsible for the data being fed on the site and undertakes not to upload any corrupt information/data which may in any manner lead to corruption of the site in any manner. The User further undertakes and accepts that he/she shall be bound to produce and disclose, by way of original documentation, any information that has been uploaded by the User on the database.
Users shall be solely responsible for confidentiality/safety of the user-id and password required for access of the subscriber’s data on the site www.docOPD.com and undertakes not to transfer (including by way of sublicense, lease, assignment or other transfer, including by operation of law) their log-in or right to use the Subscription Services to any third party.
The “DTPL” provides the Member access to a network of voluntarily participating medical professional / dentists/pharmacies/ hospitals & other medical practitioners / vendors (hereinafter referred to as 'Network Members') who are independent practicing professionals. Network Members are independent contractors in private practice and are neither employees nor agents of “DTPL” and / or its parents, subsidiaries or affiliates. The availability of any particular Network Member cannot be guaranteed, and provider network composition is subject to change without notice. “DTPL” does not provide medical, dental/pharmacy or any other treatment/medical services (hereinafter referred to as 'Medical Services') and is not responsible for outcomes. All Medical Services is the responsibility of the treating Network Member, to be carried out in consultation with the Member. Selection of the Network Member is finally the responsibility of the Member and is not based on any representations or recommendations by DTPL.
The Network Service Providers have agreed to offer their services at subsidized fee/price for the cause of increasing health awareness, specifically preventive health care & nowhere does it construe that the empanelled Network Service Providers are doing so for commercial reasons. The term "Subsidized Fee" means a service that is available to a Member at a lower cost from fees normally charged by the provider and for which the Member is solely financially responsible. The Member understands that all payments to Network Members are due and payable at the time of service.
MEMBERSHIP TERM: Once the initial "Membership Fee" and any enrollment, processing or other fee is paid and received, a Member will be entitled to the health benefits as per respective card services during the membership period which is starting from date of activation for the period of one-year. docOPD Health Card or as otherwise stated on the valid / active docOPD Health Card.
RENEWAL OF MEMBERSHIP: Members may be informed at least one month in advance before their card expiry date. It is the responsibility of the member to ensure that “DTPL” receives the payment for renewal of membership renewal at least two weeks prior to the Card expiry. “DTPL” is not responsible and assumes no liability for any disruption of service in case the payment gets delayed or the payment cheques are dishonoured. In case of dishonoured cheques, a penalty will be charged. Card services will remain suspended till the realization of the payment.
RENEWAL CHARGES: The charges for renewal can be confirmed by calling the “DTPL” Help Lines number a month in advance of the expiry date. Kindly note that any Medical Services being offered at subsidized rates or free benefits will not be offered at these rates by the Network Member as soon as the card validity has lapsed.
CANCELLATION & REFUND: If a Member wishes to cancel and / or terminate his / her Membership, he may do so by calling “DTPL” within 7 days of activation of health card. In all eventualities, decision of “DTPL” will be final and binding on all the parties. You shall further be required to return DHC Membership Kit received with all documents. Refund will be considered only when valid request by sending an email to [email protected] within 7 days of activation of health card
LOST CARD In case of loss of Membership Card, a Duplicate Card may be issued at the nominal charges of Rs. 100 /-. The tenure of the membership will remain as specified in the initial membership card.
COMPLAINTS: Members are advised to address their complaints, if any, to our representatives. They are there to help you out. However, if you are not satisfied, you may write to us at our corporate office address or mail us at [email protected]
The Member's rights or duties under this Agreement may not be assigned or delegated without the prior express written consent of “DTPL”. Member agrees that he / she will use his / her Plan or Program Membership only for his / her personal benefit or for the benefit of his / her Family Members/others who have individual docOPD Health Cards for themselves (in case of Family or Couple plan). The Member is responsible for paying Network members for all services rendered unless otherwise agreed upon by the Member and Network Member. “DTPL” is in no way responsible for the Medical Services provided by a Network Member.
The Network Member will offer the subsidized rates on treatments, procedures and services managed and serviced by the Network Member directly (& not necessarily by other doctors, visiting or consulting doctors etc) & within the premises of the Network Member, and not for any further treatment, check or service required elsewhere. It may not be necessary that all services, tests, medical fields, doctor types are covered by the docOPD Health Card & the Network Member may not be able to provide subsidized service on select procedures, i.e. the subsidized services may not be offered on all treatments and procedures offered by Network Member. Any existing offer or package at the clinic or planned by Network Member may not be clubbed and the Network Member may offer only one of the offers (either offer on “DTPL” Health Card or existing packages) or on those services.
The Member should clarify all rates and fees before going forward for any consultation, treatment or services with the DHC Network Member & should also clarify the subsidized rates/prices in advance (& all other details about the treatment, check up, test, or other services etc) & be satisfied about the same before starting the treatment. “DTPL” will not participate or be responsible for any dispute on the same (related to rates and subsidized rates once the treatment has started & costs have been incurred). If a particular Network Member does not offer the subsidized rates as per the Member's satisfaction, the Member should contact DHC Helpline numbers & “DTPL” will refer the Member to other Network Members empanelled with DHC. “DTPL” will not be responsible for providing any compensation to the Member for the charges levied by the Network Member.
“DTPL” offers different variants of DHC Health Plans to customers and features/ benefits offered could vary from one variant to the other. Please refer to your “DTPL” Health Plan welcome pack to check if some benefits are offered on your DHC Health Plan variant. In the case of a Couple or Family “DTPL” Health Plan membership, there needs to be one person designated at the time of applying as the Primary Member.
Talk to Doctor' facility offers Members the option of seeking medical opinion over the phone. “DTPL” is responsible for ensuring that the doctors involved possess the requisite qualifications to give medical advice. The ''Talk to Doctor' benefit is available 24X7 365 days. However, there may be times when doctors may be unavailable for some reason to answer the Members' call. Please note that the medical opinion / consultation given over the phone will not consider a replacement of physical medical consultation, for proper medical consultation, members will have to visit respective speciality doctor. Members are advised to visit a medical practitioner for any urgent requirement. “DTPL” does not undertake any responsibility for any treatments, services & procedures advised by the Network Members, including those advised under the 'Talk to Doctor' program. The choice of following any such guidelines is entirely at the Member's discretion.
Free Ambulance Services facility offered under certain “DTPL” Health Plan variants entitles a respective Paid Member to receive a reimbursement of a maximum amount of Rs 1,000/- from “DTPL” in case of usage of ambulance services. In order to claim this reimbursement, the Primary Member would need to submit an original bill showing usage of the ambulance services for himself/ herself within 30 days of the same, and this can be claimed for only one such usage each membership term. DHC will only reimburse those claims where the ambulance service has been utilized from a reputed hospital having at least 100 beds. In no way does DHC undertake to provide ambulance services, neither does it guarantee the services provided by any ambulance service provider.
Free Second Opinion facility offered under certain “DTPL” Health Plan variants entitles a Member to seek a medical opinion for any medical or surgical procedure by requesting and uploading medical reports in EHR section of docOPD website or mobile app for which docOPD team will revert in 48 hours with second opinion free of cost. This service will be offered by “DTPL” on a best effort basis, and “DTPL” does not guarantee that it will be able to provide this in every case.
Accident Health Insurance & Accident Medical Reimbursement - “DTPL” Health Card member will be entitled to Group Personal Accident insurance cover of INR 1 / 2 Lac from Max Bupa Health Insurance Company Limited depending upon type of cards purchased. In case, on buying additional health plan for spouse, family will be entitled for INR 1 / 2 Lac Accidental Insurance, coverage for Spouse is limited to 50% of Principal Sum Assured of Primary Insured and coverage for child up to 25% of Principal Sum Assured of Primary Insured. Health Package – “DTPL” offers free basic / comprehensive preventive health package for its Gold and Platinum cards members. For certain health tests, members will have to visit our network service provider location. Certain tests will be done by home sample collection and medical reports will be shared by email or uploaded in mobile app of member account. The health tests are facilitated through verified, authentic and licensed network service providers
“DTPL” is not a merchant, manufacturer, or provider of the Medical Services. “DTPL” does not give any warranty, express or implied, as to description, quality, fitness for any particular purpose, productiveness, or any other matter, for any services or merchandise purchased or received by a Member from a Network Member through his / her card membership. In the event that any product or service purchased or received by a Member is defective, or otherwise unsatisfactory, the Member will deal directly with the Network Member for any repair, exchange, refund or satisfaction of claim.
Each Member, for himself / herself, and on behalf of any Family Member who uses the services under the Health Card hereby forever releases, acquits and discharges each of DTPL and its employees, officers, directors, agents and affiliates from any and all liabilities, claims, demands, actions and causes of action that such Member or his / her legal representative(s) may have by reason of any damage or personal injury sustained as a result of or during the course of the use of any Medical Services.
DTPL Plans offered by DHC are not health insurance policies. The Card provides subsidized services through its empanelled Network Members at certain health care centers. The benefits provided through DHC Plans are not applicable if a Member is claiming insurance benefits on the medical services provided. The Member is obligated to pay for all health care services from those Network Members who have contracted with DTPL for providing services under the empanelment agreement.
The disputes shall be subject to the exclusive jurisdiction of the Courts at New Delhi.
You agree that you have no expectation of, or right to permanent and uninterrupted access to the Services. While the Services are intended to be accessible to you from everywhere on a 24x7 basis, from time to time and without prior notice of downtime, access to the App or the Services or to any part thereof may be suspended on either a temporary or permanent basis and either with respect to all or a certain class of users.
